By ordering products after we have made changes to these Terms and Conditions, you acknowledge your acceptance of the updated terms.

The products displayed on our Website are intended for sale exclusively to individual end buyers. These buyers must be natural persons who are purchasing the products solely for personal use and not for any direct commercial purposes.

• Pre-order

  On this Website, you have the option to place orders for products that are not currently available and can be acquired through a "pre-order" process. Please note that the availability of these pre-ordered products is subject to final confirmation, and Testoni does not provide any warranty regarding their production or manufacturing.

• Order process

  After selecting the product you desire to order, simply click on the "Order now" or "Pre-order now" button. This action will add the selected product to your virtual "Shopping Bag". You can easily keep track of your chosen products by clicking on the "Shopping Bag" button, where you have the flexibility to add or remove items as needed.

  Once you have finalized your selection and would like to verify the items in your "Shopping Bag", simply proceed to the "Checkout" section and follow the provided instructions. During this process, you will be prompted to enter your name, email address, telephone number, and delivery address.

• Payment process

  After providing the required information and confirming its accuracy, the total price of the products along with any applicable charges will be displayed automatically. Please carefully review this selection to ensure its accuracy before proceeding to confirm the order. If you are satisfied with the chosen products and the displayed price, kindly click on the "Continue to payment" button. At this stage, you will be prompted to enter your payment details. It is important to note that by clicking on the "Continue to payment" button, you are placing a binding order for the products in your Shopping Bag.

  Payment for all orders must be made at the time of placing the order. We offer a variety of payment methods to choose from, including Visa, Mastercard, American Express, Apple Pay, Union Pay, WeChat Pay, and Alipay.

• Order confirmation

  The successful completion of an order is confirmed by Testoni through a confirmation email. However, it's important to note that this confirmation email does not constitute acceptance of the customer's order by Testoni. All orders are subject to availability and acceptance. We reserve the right to decline an order for various reasons, such as if (i) products displayed on the Website are no longer available, (ii) there is a manifest price error with the products shown on the Website, (iii) we are unable to obtain payment authorization for your order, or (iv) shipping restrictions apply to a specific product.

  In the event that we are unable to fulfil your order, we will promptly notify you of this situation and provide a reimbursement for any amounts already paid for the unavailable products. Our aim is to keep you informed and ensure that you are promptly refunded for any unfulfilled orders.

  The purchase contract is considered finalized once you receive confirmation from Testoni that the products have been shipped to you. At this point, the title of the property and the risk of loss and damage associated with the products are transferred to you as the customer upon delivery.

The products are sold at the price listed on our Website at the time of the order. The prices displayed include the delivery costs, which are offered by Testoni. Testoni takes responsibility for paying any applicable customs duties, local charges, or taxes associated with the delivery. Any such fees or taxes will be handled by Testoni, and we will also handle the necessary declarations to the relevant authorities of the delivery country.

Testoni retains the right to adjust its prices at any given time. However, such changes will not affect any orders for which you have already received a confirmation email, unless there is a clear and obvious price error. In the event of a manifest price error, we will promptly notify you of the issue. You have the option to cancel your order if we inform you of the error.

• Delivery schedules

  We aim to dispatch and deliver your order, excluding pre-order items, within 10 working days from the date of your order. However, please note that in exceptional circumstances, if the products are not delivered within 30 days from the confirmation email, you have the right to cancel the contract and receive a refund for any payments made. It's important to note that this provision does not apply to pre-order products. The delivery time may vary depending on factors such as the type of product ordered, product availability, your delivery address, and the chosen delivery method. The indicated delivery dates are approximate and should not be considered strict deadlines. When you place a pre-order for a product, the delivery time may be extended or different compared to products already in stock. Testoni may provide different delivery timeframes based on whether specific products are pre-ordered or in stock at the time of the pre-order.

• Countries or regions of delivery

  The products will be delivered to the delivery address you provided during the order placement. Please note that we only offer delivery to addresses located within the following countries and regions: Europe, United States, Canada, Mainland China, Japan, South Korea, Hong Kong, and Taiwan. Unfortunately, we are unable to accept orders for delivery addresses outside of these territories. Unless otherwise agreed upon, Testoni will determine the appropriate mode of delivery and the carrier to be used for your order.

• Delivery processes

  Under a single sales agreement, Testoni reserves the right to make partial deliveries of products. In such cases, any additional delivery costs incurred will be borne by Testoni.

• Return processes
  • Return notification

    As a consumer, you have the right to withdraw from this contract within a period of fourteen (14) days without providing any specific reason for your decision. This withdrawal period allows you to reconsider your purchase and, if desired, initiate the process of returning the products.

    The withdrawal period will end fourteen (14) days after the day you receive the product(s). In cases where multiple products are ordered in a single order and delivered separately, the fourteen (14) day period will be calculated from the day you receive the last product in the order.

    To exercise your right of withdrawal, you must notify us of your decision to return the product(s) through an unambiguous statement. Please send your notification to the following email address: customerservice@testoni.com.

    To meet the deadline for withdrawal, it is sufficient for you to send your communication regarding your decision to exercise the right of withdrawal before the withdrawal period expires. Once the return has been confirmed by Testoni with a confirmation email, the return process is considered successfully completed.

    All sale and personalised items are final and not eligible for an exchange or return.

    Testoni will only accept a return and initiate the reimbursement process if the product is in brand new condition, undamaged, the security tag remains intact and undamaged, and is prevented from makeup, deodorant, perfume, and smoke contacting. Please note that without the presence of the security tag and confirmation from our quality team that the product is in pristine and undamaged condition, we will not be able to process any returns.

  • Return costs and return label

    Testoni will cover the costs associated with the return of the products. You will be provided with instructions on the recommended courier service and the specific return process to follow.   • Liability regarding the products condition

    When returning the products, it is important to ensure that they are in the same condition as they were delivered. You are responsible for any diminished value of the products resulting from handling that goes beyond what is necessary to establish the nature and characteristics of the products. It is essential to return the products intact, without any signs of use, wear, or damage. Please note that we reserve the right to refuse the return of products that have been damaged, deteriorated, or show clear signs of use beyond what is necessary for evaluating their nature and characteristics.

  • Reimbursement of returned products

    Upon receiving the returned products, we will proceed with the reimbursement of all payments received from you, excluding any supplementary costs resulting from your choice of a delivery method other than the least expensive type of standard delivery offered by us. This reimbursement will be processed promptly and, in any case, no later than fourteen (14) days from the day we receive the returned products. The reimbursement will be made using the same payment method you used for the initial transaction, unless you have expressly agreed otherwise. However, please note that the refund payment may take some time to process, as it is dependent on the policies and procedures of each individual bank. You will not incur any fees as a result of the reimbursement process.

• Defaults notifications

  It is important that you inspect the products upon delivery and promptly notify us in writing of any lack of conformity or defects. To ensure timely notification, it is crucial that you send the notice within five working days after delivery or, if the defect was not apparent during a normal inspection, within three working days after the defect has been detected. Please note that if you fail to provide such notification, the products will be deemed to be approved by you.

• Replacement of defected products

  In the event of a non-conformity or defect in the product, you have the right to request either the repair of the defect or the replacement of the product with another one that is free from defects. However, please note that we reserve the right to refuse the requested repair or replacement if it would result in unreasonable costs. If the repair or replacement cannot be carried out within a reasonable period of time, you have the option to cancel the sales agreement in accordance with applicable law. This allows you to seek a refund or other appropriate remedies as provided by law.

  This warranty provided by Testoni does not affect your legal rights as a consumer under sections 14 to 17 of the Sale of Goods Ordinance (Chapter 26 of Hong Kong Ordinances) or any other mandatory statutory rights that you may have based on the local national law. These legal rights supersede any provisions in the warranty and ensure that you are protected as a consumer in accordance with applicable laws and regulations.

Testoni holds ownership and/or authorized usage rights to all trademarks, service marks, design marks, patents, copyrights, database rights, and other intellectual property (referred to as "Intellectual Property") associated with the Website and its products. Your use of the Website does not grant you any rights, titles, interests, or licenses to any of these Intellectual Property rights. Except as expressly permitted in these Terms and Conditions, any use or reproduction of the Intellectual Property is strictly prohibited. Specifically, you are prohibited from copying or reproducing the Website or any part thereof, including the product photos.

Subject to applicable law, both parties' liability is limited to losses that are typically associated with this type of contract and were reasonably foreseeable at the time the sales contract was entered into. These Terms and Conditions do not seek to exclude or limit either party's responsibility for loss or damage in cases where such exclusion or limitation would be unlawful. This includes instances of death or personal injury caused by a party's failure to exercise reasonable care and skill, as well as cases of gross negligence or willful misconduct.

In the event that either Testoni or the customer experiences a delay or failure to fulfill their obligations under these Terms and Conditions due to circumstances beyond their reasonable control, including but not limited to strikes or labor disputes, embargoes, epidemics, diseases, natural disasters, governmental provisions, wars, fires, floods, explosions, or popular movements, neither party shall be held liable to the other. It is important to note that this provision does not authorize the customer to neglect their payment obligations. The existence of a force majeure event justifies the temporary suspension of the obligations of the affected party. However, if the duration of the delay exceeds sixty (60) calendar days from the commencement of the force majeure event, either party may terminate the relevant order immediately by providing written notice to the other party.

Testoni's Privacy Policy outlines the conditions under which we handle any personal data collected from you or provided by you (e.g., during product purchases) in accordance with the GDPR n° 2016/679, Personal Data (Privacy) Ordinance (Chapter 486 of Hong Kong Ordinances), and relevant local legislation.
